It’s been several months since The Patent Lawyer Magazine published our article titled “Covid-19, Software License Audits and Patent Litigation”. In that article, we discussed how the fallout from the Covid-19 pandemic would necessitate a proactive approach to possible software vendor audit opportunists. Here is an excerpt from that article:
Particularly with regard to patent litigation and software license audits, the pandemic will likely increase certain very real threats to companies of all sizes and industries. This means that while businesses are preserving a solvent bottom line, in-house counsel must protect their clients against attacks from emboldened software vendors and patent litigators.
We are pleased to bring much of this conversation full circle with the recent publication of our article “Vendor Software License Audits Have Become More Frequent. Are You Prepared?” just last week in Database Trends and Applications. Co-authored with our partners, Dean Bolton and Michael Corey of LicenseFortress, we give our observations regarding audit activity since the Covid-19 shutdown began just over one year ago. Not surprisingly, our admonitions from last summer continue to be instructive.
